The Korean Times reported that Samsung plans to sue Apple if the iPhone 5 features LTE. This is just one week after the verdict in the Apple v. Samsung trial, in which Samsung was found liable by a jury of violating Apple's patents and ordered to pay $1billion.
The Korean Times report clearly shows that Samsung intends to fight Apple aggressively, despite losing in court last week. As a leader in global electronic sales, Samsung is determined to protect its share in the growing and very profitable smartphone sales.
Although a number of companies hold the LTE patents, Samsung has a significant claim on LTE patent and this could cause problems for Apple if Samsung chooses to sue them in court.
Rumors are wild on the new iPhone 5, including LTE. However without Apple telling the public what the new phone features will be, it's only a matter of speculation whether or not LTE will be an included feature. To date, Samsung is trying to beat Apple to the punch by giving them a potential litigation warning.
